Synergetic Recruitment Group

The Company is a recruitment business which provides work-finding services to its clients and work-seekers. The Company must process personal data (including sensitive personal data) so that it can provide these services – in doing so, the Company acts as a data controller.

You may give your personal details to the Company directly, or we may collect them from another source such as a jobs board. The Company must have a legal basis for processing your personal data. For the purposes of providing you with work-finding services and/or information relating to roles relevant to you we will only use your personal data in accordance with the terms of the following statement.

Purpose of processing and legal basis

The Company has collected your personal data (which may include sensitive personal data) and will process your personal data for the purposes of providing you with work-finding services. The legal bases we rely upon to offer these services to you are:

We use information held about you in the following ways: 

·         To carry out our obligations arising from any contracts we intend to enter into or have entered into between you and us and to provide you with the information and services that you request from us or we think will be of interest to you because it is relevant to your career or to your organisation.

·         The core service we offer to our candidates and clients is the introduction of candidates to our clients for temporary or permanent engagement. 

·         We will in some circumstances rely on consent for particular uses of your data and you will be asked for your express consent, if legally required.  Examples of when consent may be the lawful basis for processing include permission to introduce you to a client (if you are a candidate).

Consent

Should we want or need to rely on consent to lawfully process your data we will request your consent orally, by email or by an online process for the specific activity we require consent for and record your response on our system.  Where consent is the lawful basis for our processing you have the right to withdraw your consent to this processing at any time.

Our legitimate Business Interests

Our legitimate interests in collecting and retaining your personal data:

As a recruitment business and recruitment agency we introduce candidates to clients for permanent employment, temporary work placements or independent professional contracts.  The exchange of personal data of our candidates and our client contacts is a fundamental, essential part of this process.

We believe it’s reasonable to expect that if you are looking for employment or have posted your professional cv information on a job board or professional networking site, you are happy for us to collect and otherwise use your personal data to offer or provide our recruitment services to you, assess your skills and work history against any current vacancies that we have. Then if applicable and consent is given share that information with prospective employers.

We sometimes need to use your data for our internal administrative activities, like payroll and invoicing where relevant.

Legal obligation

We have our own obligations under the law.  If we believe in good faith that it is necessary, we may therefore share your data in connection with crime detection, tax collection or actual or anticipated litigation.

Being transparent and providing accessible information to individuals about how we will use their personal data is important for our organisation. The following are details on how we collect data and what we will do with it:

What information is being collected?

The information you give us, or we collect about you may include your name, address, private, corporate e-mail address and phone number, financial information, compliance documentation, references verifying your qualifications and experience, your right to work in the United Kingdom, curriculum vitae and photograph, links to your professional profiles available in the public domain e.g. LinkedIn, Twitter, business Facebook or corporate website and any other business relevant documentation.

Who is collecting it?

All consultants within the business when required for the reasons set out below.

How is it collected?

This information we obtain about you is from direct communication via phone and email, or other sources such as LinkedIn, corporate websites, job board websites, online CV libraries, your business card, personal recommendations, and social media platforms.

Why is it being collected?

We are a recruitment agency and recruitment business as defined in the Employment Agencies and Employment Businesses Regulations 2003 (our business).  We collect the personal data of the following types of people to allow us to undertake our business;

·         Prospective and placed candidates for permanent or temporary roles;

·         Prospective and live client contacts;

·         Supplier contacts to support our services;

·         Employees, consultants, temporary workers;

How will it be used?

·         To carry out our obligations arising from any contracts we intend to enter into or have entered into between you and us and to provide you with the information and services that you request from us or we think will be of interest to you because it is relevant to your career or to your organisation.

Who will it be shared with?

 Selected third parties including:

·         clients for the purpose of introducing candidates to them;

·         candidates for the purpose of arranging interviews and engagements;

·         clients, business partners, suppliers and sub-contractors for the performance and compliance obligations of any contract we enter into with them or you;

·         subcontractors including email marketing specialists, event organisers, payment and other financial service providers

·         credit reference agencies, our insurance broker, compliance partners and other sub-contractors for the purpose of assessing your suitability for a role where this is a condition of us entering into a contract with you.

Retention period

We don’t keep data for any longer than is necessary. For most people where we have limited contact it will be for a maximum of two years from the date of last contact with us. Where we have engaged with you more extensively, for instance we have worked with you as client, or interviewed / placed you as a candidate, we may retain data longer,

We will delete it after that time except where we need to keep any personal information to comply with our legal obligations, resolve disputes, or enforce our agreements.

2.   Overseas Transfers

The Company may transfer only the information you provide to us to countries outside the European Economic Area (“EEA”) for the purposes of providing you with work-finding services. We will take steps to ensure adequate protections are in place to ensure the security of your information. The EEA comprises the EU member states plus Norway, Iceland and Liechtenstein.

3.   Data retention

The Company will retain your personal data only for as long as is necessary. Different laws require us to keep different data for different periods of time.

The Conduct of Employment Agencies and Employment Businesses Regulations 2003, require us to keep work-seeker records for at least one year from (a) the date of their creation or (b) after the date on which we last provide you with work-finding services.

We must also keep your payroll records, holiday pay, sick pay and pensions auto-enrolment records for as long as is legally required by HMRC and associated national minimum wage, social security and tax legislation if employed directly by Synergetic Recruitment Group.

Where the Company has obtained your consent to process your personal data, and or sensitive we will do so in line with our retention policy (a copy of which is available on request). Upon expiry of that period the Company will seek further consent from you. Where consent is not granted the Company will cease to process your personal, and or sensitive data.

4.   Your rights

Please be aware that you have the following data protection rights:

·       The right to be informed about the personal data the Company processes on you;

·       The right of access to the personal data the Company processes on you;

·       The right to rectification of your personal data;

·       The right to erasure of your personal data in certain circumstances;

·       The right to restrict processing of your personal data;

·       The right to data portability in certain circumstances;

·       The right to object to the processing of your personal data that was based on a public or legitimate interest;

·       The right not to be subjected to automated decision making and profiling; and

·       The right to withdraw consent at any time.
